DISTANCE SALES AGREEMENT

1. Subject of the Agreement

This Agreement has been established electronically between Alwitus Elektrik Otomasyon San ve Tic LTD ŞTİ. (“SELLER”) and the customer making a purchase via www.alwituselektrik.com (“BUYER”), within the scope of the Law No. 6502 on the Protection of the Consumer and the relevant Regulation on Distance Contracts.

By approving this agreement electronically, the BUYER accepts to pay the costs related to the product or service subject to the order via the payment methods specified on the order screen.

3. Buyer Information

The BUYER declares their billing and delivery information themselves while creating an order on the site. This information is recorded on the system for the purpose of establishing and executing the order.

4. Product Information

The basic characteristics, sales prices, payment, and delivery information of the products can be viewed by the BUYER on the site. Campaign products and prices are valid limited to the relevant campaign conditions and duration.

5. General Provisions

  • The BUYER accepts that they have read the preliminary information texts prior to the order and approved them electronically. In this context, the relevant texts are available on the Membership and Terms of Use, Shopping and Payment Security, Shipping and Delivery Conditions, and Warranty and Return Conditions pages.

  • The product shall be delivered to the address specified by the BUYER within 30 (thirty) days at the latest, in accordance with the legislation. Details regarding shipment and delivery processes are explained on the Shipping and Delivery Conditions page.

  • In the event that the fulfillment of the product/service becomes impossible, the BUYER shall be informed; the collected amount shall be refunded within 14 (fourteen) days at the latest in accordance with the legislation.

  • If the payment does not take place, the SELLER’s obligation to deliver the product does not arise.

  • The SELLER may supply an equivalent product with the BUYER’s approval instead of a product that is not in stock.

  • In the event of Force Majeure, the BUYER shall be informed; the BUYER may cancel the order or request the postponement of the delivery.

6. Invoice and Payment Information

Payment transactions are carried out with security checks via the PayTR Virtual POS infrastructure; 3D Secure may be applied for transactions deemed necessary. Detailed information regarding shopping and payment security can be accessed from the Shopping and Payment Security page.

The invoice may be transmitted physically during delivery or electronically (e-mail, etc.). The Bank Accounts page can be visited for bank account information.

7. Right of Withdrawal

  • The BUYER may exercise their right of withdrawal within 14 (fourteen) days from the date of delivery without showing any reason.

  • Notifications regarding the right of withdrawal may be transmitted to the SELLER in writing or via the Contact Page.

  • Return conditions, the method of return, and practices regarding shipping costs are explained on the Warranty and Return Conditions and Shipping and Delivery Conditions pages.

  • In the return processes of products purchased with a corporate invoice, necessary documents (return invoice, etc.) may be requested pursuant to legislation and accounting practices.

  • The SELLER refunds the price of the returned product to the BUYER within 14 (fourteen) days at the latest in accordance with the legislation.

8. Products for which Right of Withdrawal Cannot be Exercised

Product/service types for which the right of withdrawal cannot be exercised within the scope of the Regulation on Distance Contracts are reserved. Generally, the right of withdrawal cannot be used in the following cases:

  • Cables requested by the BUYER with custom measurements and products that are custom produced/adapted for the person.

  • Products supplied specifically for the BUYER.

  • Products whose packaging has been opened, which have been used, or which are not suitable for return due to hygiene.

9. Resolution of Disputes

In disputes that may arise from this agreement, the BUYER may apply to the Consumer Arbitration Committees or Consumer Courts in the place where their residence is located.

10. Approval and Effectiveness

This agreement enters into force on the date it is approved electronically by the BUYER.
